Lawyer pulled up for aspersions on ex-judge probing Vikas Dubey case

NEW DELHI, Aug 11: Chief Justice of India Sharad Arvind Bobde on Tuesday reprimanded advocate Ghanshyam Upadhyay questioning appointment of retired Justice B S Chauhan as the head of a 3-member inquiry commission set up by the Supreme Court to probe into the alleged fake encounter to bump off dreaded criminal Vikas Dubey in Kanpur last month.
The CJI flared up when the lawyer argued his petition to remove Justice Chauhan since his brother is an MLA in Uttar Pradesh and his daughter is married in a political family in Madhya Pradesh. He snubbed the lawyer that Justice Chauhan is a respected judge and aspersions on him cannot be tolerated.
When the lawyer referred to many articles written on the former Supreme Court judge, the CJI shot back that the Court does not decide on the basis of the media reports. Asking him whether any of his relative is related to the incident, the CJI said there are many judges whose brothers or fathers are MPs but it does not affect their impartiality.
Dubey was killed in what is suspected as a fake encounter when he was being brought from Ujjain to Kanpur in the police custody. His gang was accused of allegedly killing eight police personnel who had raided his residence to nab him, but he escaped. The police is being accused of a revenge killing of Dubey.
