NEW DELHI, Oct 21: Activist lawyer Prashant Bhushan, who just had a brush with the Supreme Court on the contempt of court, on Wednesday hit out at Chief Justice of India Sharad Arvind Bobde for taking hospitality of the Madhya Pradesh Government for availing its special chopper for a visit to Kanha National Park and then to his hometown Nagpur at a time when an important case is pending before him on disqualification of MLAs defecting to the BJP to help it form the government.
Pointing out that "the survival of the MP Government depends on this case," Bhushan says a writ petition against the MP Assembly Speaker was heard by a Bench headed by the CJI, with Justices A S Bopanna and V Ramasubramanian as the other two judges, on October 6 and order was passed to list the matter on November 4 for "final disposal."
In a tweet, he notes that "the CJI avails a special chopper provided by the MP Govt (authorised by the CM) for a visit to Kanha National Park& then to his home town in Nagpur, while an important case of disqualification of defecting MLAs of MP is pending before him."
His tweet puts a question mark on whether the CJI will be still hearing the disqualification case on November 4 or recuse himself to let other judges decide the matter.
Bhushan has also attached a wireless message of the deputy secretary and state protocol officer of the MP government on necessary arrangements such as accommodation, transport and adequate security etc, as he will be treated as a state guest. The message says the CJI will be reaching Jabalpur from Delhi on 17/10/2020 at 01.05 PM by flight, stay at Jabalpur. On 18/10/2020 at 12.00 PM departure to Khatia (Kanha) by Chopper. At 12.30 PM reach Khatia (Kanha). Stay and visit Kanha National Park. On 20.10.2020 at 03.30 PM departure from Khatia (Kanha) to Nagpur by Chopper.
