Session’s court dismisses Govt’s revision petition

SRINAGAR, Jul 3: The Principal District and Session’s judge Srinagar has dismissed a revision petition filed by the state government to withhold the lower court proceedings in Wamiq Farooq death case. According to advocate Aijaz Ahmad Dar, the session’s court dismissed the state’s revision petition in which the prosecution had demanded
withholding of proceedings in a lower court which had directed for the
personal appearance of IGP Kashmir. A 13-year-old boy, Wamiq died in January 2010, after he was allegedly hit by a tear smoke shell in Rajouri Kadal in old city Srinagar.
Earlier, the state government had filed a revision petition after Chief Judicial Magistrate Srinagar ordered for personal appearance of the IGP Kashmir and dismissal of the application filed by the police for withholding of court proceedings on the ground that it may be allowed to file Special Leave petition before the Supreme Court in the
matter.
On November 24, 2011 the session’s court Srinagar had stayed a trial court order by virtue of which the IGP Kashmir was directed to constitute within four weeks a SIT to probe the circumstances which led to the death of Wamiq.
The government had filed its revision petition against the order of a trial court dated October 18, 2011 in which the CJM had directed the IGP Kashmir to implement its earlier orders with regard to setting up of a SIT to probe Wamiq’s death within four weeks. Failing which, the court had asked the IGP to appear personally in the court to explain
his position on November 24, 2011.
The CJM’s October 18, 2011 order read: “….I deem it proper to allow four weeks time to do as required under order dated February 5, 2011, failing which IGP Kashmir would personally appear in this court on next date of hearing to explain as to how appropriate action as
warranted under law be not taken against him as well as against other Officers to whom directions passed in order dated February 5, 2011 were valid.”
