| | Judicial activism on Amarnath | | SC intervention has taken place after number of pilgrim death increased | | | Judicial activism has once again come into play when the Supreme Court of India issued show cause notice to the Shri Amarnath Shrine Board (SASB) officials including its chairman and officials of the home ministry on the issue of increased number of death of pilgrims during the first 17 days of the pilgrimage. The SC has initiated suo moto action taking into consideration the higher number of death of pilgrims and allowing increased number of pilgrims to holy cave shrine. Some activists had also previously sought the intervention of the judiciary when the government failed to regulate pilgrims to the extent of 3500 per day when facilities and infra-structure have been created sufficient for them. The court has also questioned the stand of the SASB for allowing more than 20,000 pilgrims on daily basis in the absence of proper infra-structure and medical facilities so precious lives could be saved. If this is the situation on this pilgrimage then why the government and SASB are waiting for judicial activism and intervention to restrict the number of pilgrims on this hazardous route when risk to human life is very high in view of the treacherous terrain through which the route passes. Moreover, all attempts to regulate the pilgrims have failed in the past due to opposition from self-styled devotees who want the yatra period to be extended every time when the schedule is chalked out for smooth conduct of pilgrimage. This has been happening without taking into consideration the risk and threat to human life on this stretch. Despite availability of medical facilities, pilgrims have continued to die enroute due to one problem or the other. The SASB and state government need to give a serious thought to the whole problem and allow a limited number of pilgrims for whom proper facilities are put in place. |
