| | Kaloo’s revision petition accepted, seized car likely to be released | | | SRINAGAR, Sep 19: A city court today accepted the revision petition filed by Altaf Kaloo, the National Conference leader against impounding of his car by the Nigeen Police Station. Kaloo, former National Conference MLC as per the FIR 110/ 2012 registered by police station Nigeen is allegedly involved in a moral turpitude case. He was caught by police allegedly “red handed” with a Doordarshan female anchor, but he managed an escape from the spot. However, the female anchor was arrested and lodged in women’s police station for a night. Besides arresting the female anchor, police seized Kaloo’s car (Scorpio), three ATM Cards, a gun license from the spot. Next evening Kaloo got a pre-arrest bail which has been extended by the upto September 25. The former NC MLC had also got a release order for his seized car from the court of sub registrar who later kept his own order in abeyance. However, Kaloo’s counsel filed a revision petition before the principal district and session’s court seeking quashment of sub registrar’s second order by virtue of which he had kept release order of Kaloo’s car in abeyance. Afaq Ahmad, Chief Prosecuting Officer (CPO) had vehemently argued before the court of sub registrar against the release order for the seized car of Kaloo. The court later kept its release order dated September 11, 2012 in abeyance. The CPO argued that since the cases was highly sensitive and involves the public sentiments; release order for the seized car of accused NC leader will hamper the investigations into the matter. “Issue notice to the other side. Meanwhile the order passed by the court dated September 11, 2012 vis-a-vis release of vehicle bearing registration number JKO1N/6565 (Scorpio) care of police station Nigeen FIR number 110/2012 shall remain in abeyance till September 18,” read the order passed by the Sub Registrar Manzoor Ahmad Zargar on September 14. As the matter came up for hearing today, the principal district and session’s judge set aside sub registrar’s second order by accepting the revision petition filed by Kaloo. After the court granted pre-arrest bail to Kaloo, Advocate Bilal Ahmad the counsel for Kaloo filed the objections to the application moved by the police for cancellation of pre-arrest bail of his client. Sources said police’s application for cancellation of pre-arrest bail granted to Kaloo has been listed for arguments in last week of this month. On the other side, the CPO had filed motion against the bail order granted by the sub registrar in favour of the female anchor of Doordarshan who was caught red handed with Kaloo allegedly in a compromising position by Nigeen police station and was lodged in women’s police station Ram Munshi Bagh. The court had later directed the accused (female anchor) to comply with the conditions of bail especially to cooperate with investigating agency and be available before the investigating officer forthwith. Kaloo and the female anchor of Doordarshan are facing charges in FIR 110 of 2012 registered by police station Nigeen under section 294 RPC (doing any obscene act in a public place) reached Nigeen police station. Interestingly, in its application filed by investigating officer of the case, the SHO Nigeen police station had said that gradation of the case from section 294 RPC to Prevention of Immoral Trafficking Act (PITA) cannot be ruled out. Section 294 of RPC pertains to doing any obscene act in any public place. It is non-bailable and can fetch punishment with imprisonment of a term which may extend to three months. “…since the investigation of case is on progress and the gradation of the case from section 294 RPC to PITA can not be rules out at this primary stage of investigation,” reads the application moved by SHO Nigeen before a Srinagar court. Meanwhile, taking note of the media reports about the female anchor who was arrested by police and booked under section 294 RPC, the Doordarshan headquarters in Delhi attached Director Doordarshan Kendra Srinagar Shami Shair to Doordarshan Headquarters New Delhi. |
