| | Application seeking eviction of MP from State land filed in HC | | Land-grabbing by politicians, police, bureaucrats | | JAMMU, Oct 30(JNF): As a sequel to PIL filed against “organized land grabbing by certain police officers/politicians/bureaucrats in connivance with land mafia/underworld in various parts of Jammu/Samba districts”, a fresh application was filed by the petitioner in the State High Court seeking eviction of Member Parliament Kathua-Udhampur-Doda constituency Chowdhary Lal Singh from State Land in district Kathua. The petitioner Prof SK Bhalla, who had earlier filed a Public Interest Litigation (PIL) against, what it was described as “organized land grabbing by certain police officers/ politicians/bureaucrats in connivance with land mafia/under world in various parts of Jammu/Samba districts”, filed this application. The application sought directions to the Chief Secretary, Commissioner/Secretary Revenue department and Divisional Commissioner Jammu to retrieve/restore 92 kanals and 6 Marlas of State land situated at village Karandi Khurd, tehsil Hira Nagar district Kathua, which, the petitioner alleged in the application, was presently under the “illegal/unauthorized possession of Chowdhary Lal Singh Member Parliament Kathua-Udhampur-Doda constituency. According to the petitioner, the said encroachment stands confirmed by the State Vigilance Organization vide its report No SVO/06/PRK-63/05-SC/4605 dated April 24, 2006. The petitioner has also sought a direction to the Principal Secretary to the Chief Minister to file the Action Taken Report (ATR) pursuant to the report of the Vigilance Commissioner bearing No SVO/06/PRK-63/05-SC/4605 dated April 24, 2006. In the application filed through advocate Virender Bhat, it has been submitted that despite the expiry of more than six years from the date of submission of report by the Vigilance Commissioner confirming the encroachment, the same has not been removed as the occupant is highly influential being a Member Parliament and a former Health Minister of J&K. “The local Revenue agency in district Kathua appears to be under pressure of the said occupant as in response to RTI plea dated May 14, 2012; the Tehsildar Hira Nagar expressed complete ignorance about the encroachment in question and also took a U-turn to the findings of the SVO,” the petition said. It has been further submitted that Chowdhary Lal Singh and his family are in possession of a huge chunk of land measuring 317 Kanals 16 Marlas at village Karandi Khurd acquired through gift deeds and sale deeds by Kanta Andotra wife of Chowdhary Lal Singh and Kamia Andotra daughter of Chowdhary Lal Singh. According to petitioner, the RB Educational Trust through its trustee Kanta Andotra is running Delhi Public School (DPS) from the aforesaid land and the said trust under the patronage of Chowdhary Lal Singh has built a huge farm house which is fully visible on spot. The petitioner has prayed that the state land measuring 92 Kanals and six Marlas under the illegal occupation of Chowdhary Lal Singh be restored to the State and Principal Secretary to the Chief Minister be directed to file an ATR in the matter to apprise the Court about the steps initiated for retrieving the said land after the Vigilance Commissioner submitted his report in April, 2006. |
