| | Purchase Scam: GDC principal in dock | | Court asks SSP Vigilance to register FIR, appoint DySP for investigations | | SRINAGAR, Nov 10: The special anti corruption court today directed SSP Vigilance Orgnaisation Kashmir (VOK) to register FIR in a case of graft against Principal Government Dental College (GDC) Srinagar. Court has also directed him to monitor himself and appoint his deputy for the investigation of the case. The order came in a complaint filed by Tanveer Hussain Khan, a social activist, who had sought direction to the vigilance orgnaisation for registration of FIR in a case of purchase of imported dental machinery and equipment involving a loss of Crores to the state exchequer. Khan had gathered information through RTI regarding purchases of various dental machinery and equipment made by college authorities including “Digital Panoramic X-ray machine” and “Complete Vertical Rack Sterilization system”. “The report filed by Vigilance Organisation Kashmir (COK) is quite suggestive of the fact that the inquiry officer during the course of enquiry has been able to gather material to this fact that machines i,e Orthophos X G5 DS Ceph had been procured at exorbitant rates to cause undue pecuniary benefits to the principal Riyaz Farooq, V L Narayan and Hamid Bashir. If the inquiry officer has been able to gather material to this fact and if in his opinion any offence is disclosed for registration of formal FIR he is at liberty to do so and prior permission of the court is no way required in the matter,” the order passed by the special judge anti corruption reads. The court has, however, directed SSP VOK to register formal FIR if in his opinion any ground for the same exists on the basis of the findings arrived at by the inquiry officer under the relevant provisions of law and thereafter take-up the investigation in accordance with law. “…SSP is further directed that in the event case is registered he shall provide audience to both the parties and get the investigation carried out by an officer not below the rank of Dy SP posted in the VOK and monitor the investigation thereof,” the court has said in its order. Khan had filed a compliant before anti corruption court on April 28, 2012 seeking directions to VOK for registration of FIR against Dr Riyaz Farooq, principal government dental college. The VOK was later directed to carry out inquiry into the allegations. The VOK filed its enquiry report on August 6, 2012. Referring to the vigilance report, the court has said the report reveals that services of two experts HOD Oral Medicine and Radiology and HOD Periodontia Government Indira Gandhi College and Hospital Jammu were obtained and experts inspected the procured OPG machine and complete vertical rack sterilization system at GDC Srinagar and also physically compared and checked the specifications of both the dental machinery equipments and complete vertical rack sterilization system manufactured by Sirona Germany and Mocom Italy respectively. “Inquiry officer reported that the dental machinery has been procured at exorbitant rates in order to cause undue pecuniary benefits to Dr Riyaz Farooq, principal GDC Srinagar V.L Narayan proprieter Villa India New Delhi and Hamid Bashir,” the court order reads. After completing its preliminary enquiry, the vigilance had sought permission from the court for registration of a formal FIR in the matter. However, the court observed: “The VOK sought permission for registration of case under the relevant provisions of law. Permission for carrying out registration of FIR cannot be ordered by court as police VOK is within its powers to register a formal FIR in the mater in the event it appears to the concerned agency that there is enough material available on the file disclosing commission of offence.” |
