| | Double lifer to 2 HM militants | | | JAMMU, Dec 3 (JNF): Court today awarded double life-imprisonment to two alleged Hizbul Mujahideen (HM) militants after 22 years investigation & trial. Presiding Officer TADA Court Sanjeev Gupta today awarded double life-imprisonment to Nazir Ahmed Sheikh alias Gul-Danter and Showkat Ahmed Khan alias Pupwaja and five years RI to Farooq Ahmed Chichoo alleged militants of HM outfit after 22 years investigation and trial. According to CBI case that on October 26, 1990, case was registered by Police Station Nishat Srinagar for offence under section 302 RPC, 3 (2) TADA (P) Act on an information that some unknown persons with intend to create terror fired at an unknown person and shot him dead leaving the body lying on the road. Then SHO Police Station Nishat reached the place of occurrence and body of the accused was sent for post-mortem. The body of was disposed on October 27, 1990 as unidentified. However, Deputy Commandant 24th Battalion of BSF lodged a missing report with Police Station Nishat regarding Dharamvir Sharma and on the basis clothing and photographs of the body it was identified by the Deputy Commandant that body was of Inspector Dharamveer Sharma. Later the investigation of the case was transferred to CBI and CBI after completion of investigation presented challan. After hearing Special Public Prosecutor ML Thusoo appearing for the CBI whereas Senior Advocate Zaffar Ahmed Shah with Advocate KL Pandita and Yogesh Bakshi for the accused, Presiding Officer TADA Court Sanjeev Gupta today convicted the accused. Court observed that accused Nazir Ahmed Sheikh alias Gul Dentar is sentenced to undergo imprisonment for life and a fine of Rs 5000 under section 302 RPC. He is also sentenced to undergo imprisonment for life and fine Rs 10,000 under section 3 (2) (I) of TADA. He is further sentenced to rigorous imprisonment for five years with a fine of Rs 5000 under section 4 of TADA. He is further sentenced to undergo RI for seven years each under section 25 & 27 of the Arms Act, being in possession of prohibited arms ammunition besides using the same and fine Rs 5000. Court clarified that all the sentences run concurrently. Regarding Accused Shoukat Ahmed Khan alias Pupwaja, court sentenced him to undergo imprisonment for life and a fine of Rs 5000 under section 302 RPC r/w section 34 RPC. He is also sentenced to undergo imprisonment for life and fine Rs 10,000 under section 3 (2) (i) of TADA with rigorous imprisonment for five years with a fine of Rs 5000 under section 4 of TADA. He is further sentenced to undergo RI for 10 yrs under section 364 RPC with affine of Rs 7000. Court further clarified that all the sentences shall run concurrently. However, court awarded five years rigorous imprisonment to Farooq Ahmed Chichoo under section 3 (2) (ii) of TADA with fine of Rs 3000. Court directed that accused shall be lodged n Central Jail Srinagar to serve this sentence and till the security arrangements are made for sending the accused to Central Jail Srinagar, they shall be kept in District Jail Jammu. |
